Supreme Court Rules Against the Navajo Nation Docket No 21-1484 June 23, 2022

On June 22nd the Supreme Court of the United States sometimes abbreviated SCOTUS decided 5 to 4 that the 1968 Treaty with the Navajo Tribe called for the U.S. to provide the land and funding for sheep, goats, cattle, and corn as well as education and some infrastructure but did not mention water. The decision of the Supreme Court was that if it did not mention water when written and agreed to, one can not just add “water” to the treaty now. The U.S. Supreme Court may not always be correct but they are last so this is likely the final legal decision on this but Congress and the Executive Branch of Government have not yet been heard from.

But then there is this part of the Court decision:

In addition, the Navajos may be able to assert the interests they claim in water rights litigation, including by seeking to intervene in cases that affect their claimed interests, and courts will then assess the Navajos’ claims and motions as appropriate. See 28 U. S. C. §1362; Arizona v. California, 460 U. S. 605, 615 (1983); see also Blatchford v. Native Village of Noatak, 501 U. S. 775, 784 (1991); Moe v. Confederated Salish and Kootenai Tribes of Flathead Reservation, 425 U. S. 463, 472–474 (1976).

So this case is over but the issue is not.

Weekly Crop Report June 22, 2023 – Drought has Become a Problem for Certain Crops.

This article is based primarily on the June 21, 2023, USDA Crop Bulletin which covers the June 12 to June 18 period of time. The USDA report usually becomes available on Tuesdays but due to a Federal Holiday, it was issued on Wednesday.

It now seems more like an average crop.  Both corn and soybeans had a very good start but the quality of the crop has been somewhat compromised by drought. Soybeans are doing a bit better than corn.

We also include the recent report on potato inventories. I vary these reports to give readers information on different crops.

The article includes a short international review of agricultural conditions.

We begin with the National Agriculture Summary.  The Tables below the summary have additional data. The boxes with my comments may be incomplete so for crops of interest check the data out yourself to be sure.

Comparison of NOAA and JAMSTEC Temperature and Precipitation Outlooks for the U.S. June 19, 2023

Recently we have published the NOAA (find it here) and the JAMSTEC (find it here) temperature and precipitation Outlooks. I have been letting my readers compare them but tonight I decided to see if I could make it easier for readers to do that.

So that comparison is in the body of this article. Surprisingly they are fairly similar aided by the forecast of an El Nino. They are by no means identical.

NOAA is predicting a stronger El Nino than predicted by JAMSTEC. This may explain some of the differences.  Looking at two different forecasts can help the reader understand the range of possibilities that are possible. Hopefully, readers will find this interesting.
